Property Owner Agreement

This Agreement governs your use of Hostora as a property owner / customer ("you") with PRODM IT SOLUTIONS ("PRODM"). It incorporates our Terms of Service, Privacy Policy and Refund Policy, and includes the Data Processing Agreement (DPA) below. By accepting at sign-up, you agree to all of it.

1. Service & licence

PRODM grants you a non-exclusive, non-transferable right to use Hostora to manage your properties for your subscription term. Plan, fees and taxes (GST) are as shown in-app; renewal and non-payment consequences follow the Terms of Service and Refund Policy.

2. You are the Data Fiduciary

You are the Data Fiduciary for the resident/occupant data you collect and manage, and you warrant that you: (a) collect it lawfully and keep it accurate; (b) obtain all required consents — including verifiable parent/guardian consent for minors — before entering KYC or other personal data; and (c) comply with the DPDP Act, Aadhaar/UIDAI rules, tenancy/PG and tax law. You will not enter another person's data without a lawful basis.

3. PRODM is your Data Processor (DPA)

PRODM processes resident data only on your documented instructions to provide the Service:

  • Purpose/duration — hosting, rent/dues computation, owner-enabled reminders/alerts,

receipts/statements, and KYC storage, for the subscription term plus the deletion window.

  • Security — encryption at rest for government IDs (AES-256-GCM), TLS in transit,

role-based access, signed sessions, audit logging, rate limiting.

  • Sub-processors — hosting (Vercel), database (Neon), your chosen payment gateway, and

WhatsApp/SMS providers; engaged under equivalent obligations, with notice of changes.

  • Assistance & breach — PRODM assists with data-principal requests and notifies you

without undue delay of any personal-data breach affecting your data.

  • Return/deletion — on termination you may export your data; thereafter it is deleted per

the Privacy Policy, subject to legal retention.

  • International transfer — data may be processed outside India consistent with the DPDP Act.

4. Payments to/from residents

Where you enable online payments, resident↔owner payments run through your own gateway/UPI account. PRODM merely facilitates and is not a party to, and not responsible for, the underlying rent, deposit, refund or dispute. Resident settlement/deposit/refund terms are governed by your house rules — not by PRODM.

5. IP & data ownership

PRODM owns the software and brand. You own your data, and grant PRODM a limited licence to host and process it solely to provide and support the Service.

6. Warranties, liability & indemnity

The Service is provided "as is". PRODM's aggregate liability for any claim is limited to the fees you paid in the prior 3 months; no indirect or consequential damages (subject to non-excludable law). You indemnify PRODM against claims arising from your data or operations, including resident/guardian claims about data collected without a lawful basis or consent.

7. Term, termination & governing law

Either party may end the subscription per the Terms of Service and Refund Policy. On termination you get a reasonable export window, after which data is deleted (subject to legal retention). This Agreement is governed by the laws of India; courts at [CITY, STATE] have exclusive jurisdiction.
