Terms of Service

Hostora is operated by PRODM IT SOLUTIONS ("PRODM", "we", "us", "our"). These Terms govern your access to and use of the Hostora platform and related services ("Service"). By creating an account, logging in, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Definitions

Service — the Hostora software, websites, apps and APIs. Customer / you — the person or organisation that registers an account (a PG/hostel/co-living owner, manager or authorised staff). Resident — a student/tenant/guardian whose data the Customer manages. Subscription — a paid or trial plan granting access.

2. Eligibility and account

You must be at least 18 and have authority to bind the organisation you register for. Public sign-up creates the account owner; the owner may add managers, wardens and accountants who join the owner's organisation. You are responsible for keeping your credentials confidential and for all activity under your account, and must notify us promptly of any unauthorised use. New accounts may require approval/activation before full access.

3. Subscriptions, fees, taxes and trials

The Service is offered on plans (such as Starter / Pro / Business) and may include a free trial; plan features and limits are described in-app. Fees, billing cycle and applicable taxes (including GST) are as shown at purchase; where registered, our GSTIN is [GSTIN]. Paid subscriptions may renew unless cancelled before renewal. We may change pricing or plans on reasonable prior notice, applying from the next billing cycle. Non-payment may lead to a grace period, then read-only access, and ultimately suspension.

4. Acceptable use

You agree not to use the Service unlawfully; upload malicious code; attempt to breach security, scrape, or reverse-engineer the Service; resell or sublicense without authorisation; or use the Service to infringe others' rights or send unlawful communications.

5. Your responsibilities and data protection

You are the Data Fiduciary for the Resident Data you collect and manage. You are responsible for collecting it lawfully, for its accuracy, and for obtaining all necessary consents — including verifiable guardian consent for minors — before entering KYC or other personal data. We act as your Data Processor and process Resident Data on your instructions, as described in our Privacy Policy. You are responsible for your own legal compliance (tenancy, rent agreements, Aadhaar/UIDAI usage, tax, local licensing). Do not enter another person's data without a lawful basis.

6. Payments to/from residents

Where you enable online payments, payments between you and your residents are processed through your own gateway/UPI account. PRODM merely facilitates and is not a party to those transactions and is not responsible for the underlying rent, deposit, refund or dispute between you and a resident. Resident settlement, deposit and refund terms are governed by your house rules and agreements, not by PRODM.

7. Intellectual property

We (and our licensors) own all rights in the Service software and brand, and grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription. You own your data, and grant us a limited licence to host and process it solely to provide and support the Service. Hostora is developed by PRODM IT SOLUTIONS; attribution may appear in the product and generated documents.

8. Third-party services

The Service integrates optional third-party services (payment gateways, WhatsApp/SMS providers, hosting). Your use of those is subject to their terms, and we are not responsible for their acts or omissions.

9. Availability and warranties

We aim for high availability, but the Service is provided "as is" and "as available" without warranties of any kind to the maximum extent permitted by law. We may perform maintenance and may modify or discontinue features with reasonable notice.

10. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, data or goodwill. Our total aggregate liability for any claim is limited to the fees you paid to us in the 3 months before the event giving rise to the claim. Nothing limits liability that cannot be limited under applicable law.

11. Indemnity

You will indemnify and hold PRODM harmless from claims arising out of your use of the Service, your data, or your breach of these Terms or of law — including claims by residents/guardians relating to data you collected without a lawful basis or consent.

12. Suspension and termination

You may cancel at any time (see the Refund Policy). We may suspend or terminate access for non-payment, breach, or unlawful use. On termination, your right to use the Service ends; for a reasonable window we will allow you to export your data, after which we may delete it, subject to legal retention.

13. Governing law and disputes

These Terms are governed by the laws of India. The courts at [CITY, STATE] have exclusive jurisdiction, subject to any binding arbitration the parties agree to in writing.

14. Changes

We may update these Terms; material changes will be notified in-app or by email. Continued use after changes take effect constitutes acceptance.
